Welcome to MX Parts AU. By accessing or using our website and services at mxpartsau.com, or by purchasing, installing or using any product we sell, you agree to be bound by these Terms of Service. Please read them carefully, including the safety warnings and the Assumption of Risk and Release of Liability sections below, before placing an order.

General Terms

By using this website, you confirm that you are at least 18 years of age, or that you have the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. We reserve the right to refuse service to anyone for any reason at any time. All content on this site, including text, images, and product designs created by MX Parts AU, is our intellectual property and may not be reproduced without written permission.

Products and Pricing

We make every effort to display product colours, images, and descriptions as accurately as possible. However, we cannot guarantee that your screen displays colours exactly as they appear in person. All prices are listed in Australian Dollars (AUD) and are subject to change without notice. We reserve the right to correct any pricing errors and to cancel orders placed at an incorrect price.

Intended Use and Off-Road Use

Many products sold by MX Parts AU are performance, aftermarket or custom parts intended for off-road, competition or recreational use only. They may not comply with road-traffic, vehicle-standards, registration, insurance or other laws in your state, territory or country, and may not be legal for use on public roads.

It is your responsibility to determine whether a product is suitable and lawful for your intended use, vehicle and location before purchasing, installing or using it. MX Parts AU does not warrant that any product is road-legal or compliant with the laws of any particular jurisdiction.

Geographic restriction. Due to insurance and liability requirements, brake components are not available for purchase or shipment to the United States or Canada. Orders that cannot be lawfully or safely supplied to a destination may be cancelled and refunded.

Assumption of Risk

Riding electric and motorised bikes and motorsport-style activities are inherently dangerous. The installation and use of aftermarket, performance or custom parts may increase the risk of accident, injury, property damage or death. To the maximum extent permitted by law, by purchasing, installing or using any product sold by MX Parts AU, you voluntarily acknowledge and assume all risks associated with that purchase, installation and use, whether known or unknown.

Installation, Inspection and Maintenance

All parts must be installed by a suitably qualified technician. We do not recommend or support DIY installation. You are responsible for ensuring that every product is correctly installed, inspected before each use, and regularly maintained in accordance with any instructions provided and good industry practice.

Improper installation, modification, misuse, neglect, or failure to follow instructions may result in product failure, serious injury or death. To the maximum extent permitted by law, you assume all responsibility for the proper installation, operation, inspection and maintenance of the products you purchase.

Critical Safety Notice – Brake Components

WARNING. Brake systems and brake components are critical safety parts. Improper selection, installation, maintenance or use may result in reduced braking performance, brake failure, loss of control, serious injury or death.

All brake-related components must be installed and inspected by a qualified technician before use, and must be checked and maintained regularly thereafter. You are responsible for confirming that a brake component is compatible with your specific vehicle before fitting it. To the maximum extent permitted by law, you assume all risks associated with the purchase, installation, maintenance and use of brake components. Nothing in this clause excludes any rights you may have under the Australian Consumer Law.

Minors

Our products are not intended for sale to or use by persons under 18 years of age without parental or guardian supervision. If any product is purchased for, or used by, a person under 18, the parent or legal guardian accepts these Terms on the minor’s behalf and, to the maximum extent permitted by law, assumes all risk and full responsibility for the minor’s use of the product, including supervision and the provision of appropriate protective equipment.

Custom Decals, Stickers and Graphics

MX Parts AU offers custom printing services for decals, stickers, and graphics. By placing an order for any custom-printed product, you acknowledge and agree to the following:

  • You are solely responsible for ensuring that you have the legal right, licence, or authorisation to use any logos, trademarks, brand names, images, or designs that you request to be printed.
  • MX Parts AU acts as a print service provider only. We produce custom orders based on customer specifications and do not verify or warrant the intellectual property rights of any design submitted or selected by the customer.
  • MX Parts AU does not claim ownership of any third-party logos or trademarks featured in custom products. All trademarks and logos remain the property of their respective owners.
  • By placing a custom order, you indemnify and hold harmless MX Parts AU, its owners, employees, and affiliates from any claims, damages, losses, or legal proceedings arising from the use of logos, trademarks, or designs that you do not have authorisation to use.
  • Custom and personalised products are final sale and cannot be returned or refunded unless they arrive with a manufacturing defect or otherwise fail to meet a consumer guarantee. Please refer to our Refund Policy for more details.

Orders and Payment

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason, including stock availability, pricing errors, geographic restrictions, or suspected fraudulent activity. Payment is processed at the time of purchase via our secure payment providers. We accept major credit cards, PayPal, and other methods displayed at checkout.

Shipping and Delivery

Shipping terms, estimated delivery times, and costs are outlined in our Shipping Policy. Risk of loss for items passes to you upon delivery to the carrier. MX Parts AU is not liable for delays caused by shipping carriers or customs authorities. Certain products, including brake components, are not available for shipment to all destinations (see Intended Use and Off-Road Use above).

Returns and Refunds

Returns and refunds are subject to the conditions outlined in our Refund Policy. Custom and personalised products, gift cards, and sale items are excluded from change-of-mind returns, but nothing in our Refund Policy limits your rights under the Australian Consumer Law where a product is faulty or fails to meet a consumer guarantee.

Parts Warranty

Physical parts carry a 30-day warranty against manufacturing defects. Full terms are outlined on our Parts Warranty page. Decals and graphics are not covered under this warranty as they are print-on-demand products. This warranty is in addition to, and does not limit, any rights you have under the Australian Consumer Law.

Warranties and Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Our products are not sold “as is” to consumers, and nothing in these Terms attempts to exclude, restrict or modify the consumer guarantees (including as to acceptable quality and fitness for any disclosed purpose) that apply to your purchase.

Subject to those consumer guarantees and to the maximum extent permitted by law, MX Parts AU makes no other warranties, express or implied, in relation to the products. You remain responsible for determining the suitability, compatibility and fitment of any product for your intended vehicle and use.

Release of Liability

To the maximum extent permitted by law, and except for liability that cannot be excluded under the Australian Consumer Law or other applicable law, you release MX Parts AU, its owners, employees, partners and affiliates from all liability for any loss, damage, injury or death arising from the use, installation, modification, misuse, or failure to inspect or maintain any product, including where caused by your own act or omission or that of any third party you engage. Nothing in this clause operates to exclude, restrict or modify any liability that cannot lawfully be excluded, restricted or modified.

Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend and hold harmless MX Parts AU and its owners, employees, partners and affiliates from and against any claims, liabilities, damages, losses or expenses (including reasonable legal costs) arising out of or related to your purchase, use, installation, modification or misuse of any product, your breach of these Terms, or your infringement of any law or third-party right (including the intellectual property indemnity for custom orders above). This indemnity does not apply to the extent a claim arises from MX Parts AU’s own breach of a consumer guarantee or its negligence.

Limitation of Liability

To the maximum extent permitted by law, MX Parts AU shall not be liable for any indirect, incidental, special or consequential damages arising from the use of our products or services. Where liability cannot be excluded but can be limited, our total liability for any claim is limited, at our option, to resupplying the relevant product or service or paying the cost of resupply, and in any event shall not exceed the amount you paid for the specific product giving rise to the claim. This clause does not limit any liability that cannot be limited under the Australian Consumer Law.

Australian Consumer Law

Nothing in these Terms of Service excludes, restricts or modifies any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted or modified by agreement. If any provision of these terms is inconsistent with the Australian Consumer Law, that provision is to be read down or severed to the extent of the inconsistency.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, and any applicable Commonwealth laws of Australia, without regard to conflict-of-law principles. You and MX Parts AU submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.

Acknowledgment and Acceptance

By purchasing, installing or using any MX Parts AU product, you acknowledge that you have read, understood and agreed to these Terms of Service, including the safety warnings and the Assumption of Risk, Critical Safety Notice and Release of Liability sections, and that you accept the associated risks to the extent described above.

Privacy

Your personal information is handled in accordance with our Privacy Policy.

Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Continued use of the website, or purchase or use of our products, after changes are posted constitutes acceptance of the revised terms.
